Appeals court reverses stay on scheduled Missouri execution
ST. LOUIS (AP) - The 8th U.S. Circuit Court of Appeals is allowing a Missouri execution to go forward, arguing the inmate was given the legal due process he is entitled to.
The court ruled in favor of Missouri officials in the case of Andre Cole, who was convicted in the 1998 stabbing death of a man over child support payments in St. Louis County. The state plans to execute Cole on Tuesday evening.
A U.S. district judge had put the execution on hold, saying Cole should not be executed because of mental illness.
The Missouri Attorney General's Office quickly appealed to the 8th U.S. Circuit Court of Appeals, arguing there was no legal reason for the judge to overturn the Missouri Supreme Court ruling that allowed the execution to proceed.
