Attorney General Appeals Ruling to Release Helmig
JEFFERSON CITY - Attorney General Chris Koster said Monday he had filed an appeal to a judge's ruling to release convicted murderer Dale Helmig from prison. The judge in the case gave Koster until Monday to file his appeal. Helmig has been in prison for fourteen years, convicted of murdering his mother in 1993. This month, a judge in Dekalb County ruled that Helmig could not have committed the crime, and that his trial was unconstitutional.
In his appeal, Koster said the judge exceeded his jurisdiction in the ruling on Helmig's case, including the plan to set him free to await a new trial. Koster's appeal also said the case does not warrant a new trial.
Helmig's attorney told KOMU8 News he would move to get a ruling from the judge as soon as possible and was still hoping for his client's release later this month or in early December.
