Judge Denies Restraining Order Over Missouri Court Fee
JEFFERSON CITY - A Missouri judge has refused to halt collections by municipal courts of a special fee that goes into a retirement fund for sheriffs.
Local government officials, the city of Slater and the Missouri Municipal League filed suit this week challenging the $3 fee in municipal court cases. On Friday, Cole County Circuit Judge Jon Beetem declined a request for a temporary restraining order and scheduled another hearing for September 13th.
Missouri lawmakers created the retirement fund and the fee in 1983.
The lawsuit states that municipal courts were told this summer that they, too, would have to begin levying the surcharge. The lawsuit asserts applying the fee in municipal courts violates portions of the Missouri Constitution on access to courts and unfunded mandates.
