New Eminent Domain Restrictions take Effect Monday
New restrictions on the use of eminent domain also take effect Monday. The U.S. Supreme court ruled last summer that governments could take private property and give it to another private interest to increase tax revenues. But a new state law bans governments from taking private property for the sole reason of increasing taxes or creating jobs. The new standard also boosts the level of compensation for those whose property is taken under the law. Again this law, and the others we mentioned before, will take effect tomorrow.
