Rios Will Return to Missouri
Last week Missouri's Supreme Court decided not to review an appeals court decision to grant the former police officer a new trial.
Now Boone County officials must bring the former Columbia police officer back from his out-of-state prison. The Missouri Department of Corrections couldn't say exactly when Rios will return, only that they received a mandate yesterday requiring them to escort him back.
The state moved the former police officer out of state after his 2005 conviction, to ensure his safety. Because he's a former Columbia police officer, Rios is currently in protective custody in Bayport, Minnesota.
State officials transferred Rios to Minnesota after a Clay County jury found him guilty of murdering Valencia. However, earlier this year an appeals court ordered that Rios be granted a new trial after dismissing some evidence in the his original trial as hearsay.
There's no decision yet on when Rios' new trial will be, but it should begin in early 2008.
