COLE COUNTY - Judge Callahan denies Attorney General Jay Nixon's lawsuit against Governor Blunt's e-mails.

Cole County Judge Richard Callahan denied a lawsuit brought by Attorney General Jay Nixon's office. The suit is against Governor Matt Blunt.

The e-mail lawsuit sought the release of e-mails the Attorney General accuses the governor of deleting.

An investigator for the A-G's office, Mel Fisher was the actual person who filed the suit. Fisher was unable to prove to Judge Callahan that the alleged deletion of e-mails had personally harmed him, and for that, Callahan dismissed the case.

We were unable to speak with Governor Blunt directly, but Blunt's Press Secretary Jessica Robinson issued the following statement today:

"The court has made an excellent decision in dismissing this political lawsuit filed by Jay Nixon's political operatives."

But, a Nixon press aide released this statement, saying the Attorney General's office will: "remain committed to ensuring that all public documents are open and available."

They say they will review the order and will make sure the independent investigative team has all the legal tools needed to accomplish this important work.

The Attorney General's office wants the e-mails to look into allegations that blunt's office violated the sunshine law. Blunt's office says it did not violate the sunshine law and that it saves every e-mail.

Blunt's office accuses Jay Nixon of being the one who deletes his e-mail.
