COLUMBIA - Steven Rios may be closer to getting a new trial on Tuesday night.

Attorney General Jay Nixon wants a Missouri court to either re-hear his case or send it to the Missouri Supreme Court. Nixon's office filed a motion with the Missouri Western District Court on Monday.

In April, a three-judge panel overturned Rios's conviction because of hear-say evidence.

In 2005, a jury convicted Rios in the murder of MU student Jesse Valencia.
