LAKE OZARK - Residents near a Lake of the Ozarks Quarry were back in court today for a second time in just more than a week.

The residents got a clear message from the judge today that blasting at the Quarry would stop.

Residents and the Lake Ozark - Osage Beach Sewer Board took Magruder Limestone to court Sept. 15.

Both groups wanted blasting at the site to stop, and a judge upheld a stay that residents believed would stop the blasting, but it didn't.

"They did a small blast here on the upper part where you can see the rock has been disrupted," Resident Ted Windels said.

The rock was disrupted by a blast that neighbors said occured Friday, after Judge Kenneth Oswald issued the stay.

But Magruder said it could continue blasting because on Sept. 17, two days after the stay, it applied for a new land disturbance permit.

Magruder's attorneys claimed the permit allowed them to clear land as long as the Quarry didn't sell the rock.

Magruder's vice president said this whole situation is blown out of proportion, but Judge Byron Kinder didn't think so. He upheld the original stay, ending blasting for now.

Judge Kinder looked at the possibility of a bond for Magruder. The Miller County court will hold a separate hearing to determine that issue.
