The incident happened on January 27, 2008. Four days later, a 26-year-old man reported he was assaulted at the night club that same night. The victim identified Jason Horton as one of the suspects that had assaulted him. A witness also stepped forward identifying Horton as assaulting the victim.

This case remains under investigation and there may be additional arrests.

Horton was arrested for third degree assault. According to Missouri statutes, the penalty for this crime is considered a class A misdemeanor. The maximum penalty is up to a year in prison and as much $1,000 in fines.
