Alyssa Bustamante's Request to Set Aside Guilty Plea Denied
COLE COUNTY - A Cole County Judge has denied a request from Alyssa Bustamante to set aside her guilty plea from a second-degree murder charge back in February of 2012.
The court originally charged Bustamante with first-degree murder. She pleaded guilty to second-degree murder and armed criminal action in the October 2009 killing of 9-year-old Elizabeth Olten in St. Martins, just west of Jefferson City. Bustamante was 15 at the time. Olten was Bustamante's neighbor.
Her attorney said her due process rights were violated and that she faced cruel and unusual punishment. Her lawyer asserted her public defenders were not effective.
Judge Patricia Joyce of Cole County denied the request Thursday.
