Attorneys Argue Evidence in Harvey Murder Case

COLUMBIA - Murder suspects Chester and Angela Harvey want evidence against them thrown out. The husband and wife were in Boone County today charged with first degree murder in the death of James McNeely. Judge Kevin Crane heard motions to suppress evidence from the defense. If the Harveys win the argument, the motions would exclude evidence gathered using certain search warrants.

Angela and Chester's two sons have also been implicated in McNeely's death. Chad Harvey has already plead guilty to second degree murder for his part in McNeely's death.

Prosecutors called members of the Missouri State Highway Patrol and the Audrain County Sheriff's Department to the witness stand. They described their part in the search of the Harvey's Laddonia home as well as the refrigerated semi-trailer where McNeely's body was found.

The motive for the McNeely murder has not yet been reported, but conflicts developed in the Harvey household when McNeely moved in.

Defense attorneys are contesting the validity of the search warrants on the grounds that the warrants don't state the particular evidence sought. Typically, warrants must state specific pieces of evidence.

Judge Crane did not rule on today's motions.

Chester Harvey is scheduled for trial on Feb. 12, 2011 in Boone County.
