David Huffman is suing the Tri-County Lodging Association and other entities, saying he believes revenues for the tax were being used unlawfully and unconstitutionally.

The defendants refused to comment on camera, saying they have been advised not to speak as they have not yet been served. The lawsuit was filed on Tuesday in Camden County circuit court.

For years, Huffman says he paid the tax, but he insists he never received any benefits from the taxes.

"The tax was designed to be collected by the county and spent for the promotion of tourism that would then benefit the lodging owners that were paying the tax, and that didn't happen with my client," said Huffman's attorney David Moen.

The lodging association had sent a letter to Huffman, asking him to pay his taxes. Jim Divincen, the association's executive vice president, also furnished a statement stating Huffman's allegations are without merit.
