New Judge Named to Case Against Missouri Prosecutor
JEFFERSON CITY (AP) - A St. Louis County judge has been appointed to preside over an attempt to remove the Montgomery County prosecutor from office.
The state Supreme Court on Monday appointed Circuit Judge Richard Bresnahan to the case against prosecutor Lee Elliott. That comes after Montgomery County Circuit Judge Keith Sutherland removed himself from considering it.
Sutherland issued a temporary order last week barring Elliott from carrying out his duties as prosecutor until it can be decided whether he should be permanently removed from office.
Attorney General Chris Koster says Elliott should be ousted because he acted as a defense attorney for a person facing a misdemeanor speeding charge in municipal court.
Elliott has declined to comment about the case.
